A product page, price, photograph, description, “Buy Now”, “Buy on Amazon”, “Buy on Flipkart”, “Shop Now” or similar button displayed on the Website does not by itself constitute a direct sale of that product through this Website.

2. THIRD-PARTY MARKETPLACE PURCHASES

Purchase buttons or links appearing on the Website may redirect users to independent e-commerce marketplaces, including Amazon, Flipkart or other marketplace platforms (“Third-Party Marketplaces”).

TRAJECTORY® is a registered trade mark in India.

The TRAJECTORY word mark is registered under:

  • Trade Mark No. 4183905 – Class 9

  • Trade Mark No. 5071744 – Class 20

  • Trade Mark No. 5612321 – Class 25

The stylised “T” device mark is separately registered under:

  • Trade Mark No. 5612318 – Class 20

All rights reserved.

The relevant TRAJECTORY registered trade marks are registered in the name of Trajectory Marketing LLP.

The TRAJECTORY word mark registered under Trade Mark No. 5071744 in Class 20 includes, among other goods, neck pillows and travel pillows.

Unauthorised use of TRAJECTORY or any identical or deceptively similar mark in connection with competing goods, advertising, sponsored listings, marketplace listings or other commercial communications may be subject to enforcement where such use infringes the registered trade mark, constitutes passing off, takes unfair advantage of the mark, or creates an actionable likelihood of confusion regarding source, affiliation, sponsorship or endorsement. All rights reserved.

The Website is operated by Trajectory Marketing Private Limited. Nothing contained on this Website or in this Legal Notice transfers ownership of a registered trade mark from its registered proprietor.

Unless otherwise stated, original materials appearing on the Website, including:

  • brand elements;

  • logos;

  • device marks;

  • graphics;

  • product photographs;

  • videos;

  • written content;

  • product descriptions;

  • false endorsement;

  • impersonation; or

  • another violation of applicable law.

Unauthorised use of TRAJECTORY® or associated marks in:

  • marketplace listings;

  • product titles;

  • sponsored advertisements;

  • advertising campaigns;

  • domain names;

  • metadata;

  • keywords;

  • product packaging;

  • social-media advertising; or

  • other commercial communications

may be subject to appropriate enforcement where such use infringes applicable intellectual-property rights, constitutes passing off or creates an actionable likelihood of confusion regarding source, origin, affiliation, sponsorship or endorsement.

Nothing in this Legal Notice is intended to prohibit legitimate descriptive, nominative, comparative or other use permitted by applicable law.

19. GOVERNING LAW AND JURISDICTION

Non-Consumer and Commercial Disputes

This clause applies only where the courts at New Delhi otherwise possess jurisdiction under applicable law.

Consumer Disputes

Nothing in the above exclusive-jurisdiction clause is intended to deprive a consumer of any:

  • Consumer Commission;

  • court;

  • jurisdiction;

  • venue;

  • regulator; or

  • statutory remedy

made available to that consumer by mandatory applicable law.

Where mandatory consumer law permits a consumer to institute proceedings in another legally competent forum, that statutory right shall prevail.
